Terms of Service

These Terms govern access to Bigger Referrals, including its referral groups, shared records, account features, support tools, and business membership features.

1. Agreement to these Terms

By requesting an account, accepting an invitation, creating or using an account, or otherwise accessing Bigger Referrals, you agree to these Terms. If you do not agree, do not use the Service. If you use Bigger Referrals for a business or other organization, you represent that you are authorized to accept these Terms on its behalf.

Bigger Referrals is intended for adults participating in professional referral activity. You must be at least 18 years old and legally capable of entering into binding agreements.

2. What Bigger Referrals is

Bigger Referrals is a referral marketplace and shared recordkeeping service for closed professional groups. Members can publish referral reward terms, send referrals, record outcomes, track amounts members say are owed, record claimed payments, confirm receipt, communicate about disputes, and preserve a history of changes.

Bigger Referrals is not a bank, money transmitter, escrow service, collection agency, accounting firm, law firm, investment adviser, financial adviser, tax adviser, or payment processor for referral rewards. Referral rewards are arranged and paid directly between members outside the Service.

3. Accounts, review, and security

Bigger Referrals is a closed-membership service. Submitting an access request does not create an account and does not guarantee acceptance. Accounts may be approved, denied, limited, suspended, or removed after human review.

You are responsible for maintaining control of your account, credentials, authentication factors, devices, and recovery methods. You may not share an account, impersonate another person, bypass access controls, or attempt to access records you are not authorized to see. If you believe your account has been compromised, contact support promptly.

4. Referral offers and member agreements

Members decide their own referral terms. A reward amount, percentage, success condition, deadline, or other term displayed in the Service is a record of information entered or accepted by members. Bigger Referrals does not negotiate those terms for you and does not become a party to the underlying referral arrangement.

Unless a permitted correction is made, the offer terms attached to a referral when it is sent are the terms preserved with that record. Corrections may require a reason and may preserve prior values so that the history is not silently rewritten.

5. Accuracy and verification

Referral details, client information, deal values, reward amounts, payment methods, payment references, dates, statuses, notes, and confirmations may be entered by members or administrators. Bigger Referrals does not independently verify every entry and cannot guarantee that any member-entered record is complete, accurate, current, lawful, or truthful.

A status such as signed, due, paid, confirmed, disputed, or similar wording describes the state of the Bigger Referrals record. It is not a bank confirmation, settlement record, audit opinion, receipt from a payment network, or independent certification by Bigger Referrals.

Keep any source documents, invoices, contracts, receipts, bank records, tax records, correspondence, or other evidence you need outside Bigger Referrals. The Service should not be your only copy of information that is legally, financially, or operationally important.

6. Referral payments

Bigger Referrals does not hold, transmit, settle, escrow, guarantee, reverse, collect, or enforce referral reward payments. Members are responsible for paying one another through methods they choose outside the Service and for complying with any tax, reporting, licensing, contract, or other legal obligations that apply to those payments.

Bigger Referrals may allow a business to record that it sent a payment and may allow a referrer to confirm receipt. Those actions create or update a shared record only. They do not prove that funds moved or that a payment was legally sufficient.

7. Bigger Referrals membership billing

Paid Bigger Referrals memberships, if applicable, are separate from referral rewards. Membership charges are processed through a third-party payment provider. The provider may collect and process payment method information under its own terms and privacy practices. Bigger Referrals may receive billing identifiers, subscription status, dates, and limited payment-status information needed to manage access, but the Service is not intended to store full card or bank credentials.

Current prices, promotions, trial periods, renewal timing, and cancellation options are shown in the applicable billing flow. Unless otherwise stated there, recurring subscriptions renew automatically until canceled. Fees already earned or charged are nonrefundable except where required by law or expressly stated otherwise.

8. Client and third-party information

A member may submit a prospective client's name, contact information, service need, budget range, notes, or similar referral information. The submitting member is responsible for having an appropriate and lawful basis to share that information and for limiting the submission to information reasonably needed for the referral.

Do not submit Social Security numbers, government identification numbers, bank or card credentials, passwords, authentication codes, medical or health information, biometric data, or other highly sensitive information. Bigger Referrals is not designed to receive or store those categories through referral records.

9. Group membership and exclusivity

Groups may reserve one seat for a defined business category. Category definitions, conflicts, group boundaries, membership limits, and exceptions may be determined by group leaders or Bigger Referrals. Exclusivity applies only within the applicable group and defined category. It is not a promise of geographic exclusivity, market exclusivity, lead volume, revenue, or business performance.

10. Disputes and moderation

Bigger Referrals may provide tools for members to flag records, explain disagreements, and request review. Group leaders or platform administrators may review records and communications relevant to a dispute. Moderation decisions are human decisions and may include warnings, corrections, restrictions, suspension, or removal.

Bigger Referrals is not a court, arbitrator, debt collector, or substitute for legal process. A moderation decision about what the Service displays does not determine legal liability between members and does not prevent a party from using lawful remedies outside the Service.

11. Your content and permissions

You retain ownership of content you submit, subject to any rights held by other people. You grant Bigger Referrals a nonexclusive, worldwide, royalty-free license to host, store, reproduce, process, display, transmit, and otherwise use submitted content as reasonably necessary to operate, secure, support, improve, and administer the Service and to comply with law.

You represent that you have the rights and permissions needed to submit the content and that your use of the Service will not violate another person's privacy, intellectual property, contract, publicity, or other rights.

12. Acceptable use

You may not use Bigger Referrals to:

  • commit fraud, deception, harassment, threats, discrimination, or other unlawful conduct;
  • submit false referral outcomes or payment records intentionally;
  • scrape, harvest, sell, or misuse member or prospective-client information;
  • upload malware or attempt to probe, bypass, defeat, or interfere with security controls;
  • access another member's records without authorization;
  • use the Service to collect prohibited sensitive information; or
  • interfere with the operation of the Service or another member's use of it.

13. Data exports

The Service may allow you to download records, including CSV exports. Once data is downloaded to your device, email, cloud drive, spreadsheet software, or another system, that copy is outside Bigger Referrals' technical controls. You are responsible for protecting exported files, limiting access, making appropriate backups, and securely deleting copies when they are no longer needed.

14. Service changes and availability

We may add, remove, modify, suspend, or discontinue features and may perform maintenance or security work. We do not promise uninterrupted, error-free, or permanent availability. Features may depend on third-party infrastructure and services.

15. Disclaimers

To the maximum extent permitted by law, Bigger Referrals is provided on an "as is" and "as available" basis. We disclaim warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and results. We do not guarantee referrals, clients, revenue, payment, collection, tax treatment, legal enforceability, group performance, or any particular business outcome.

16. Limitation of liability

To the maximum extent permitted by law, Bigger Referrals and its operators, owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost business, reputational harm, or disputes between members arising from or related to the Service.

To the maximum extent permitted by law, the aggregate liability arising from or related to the Service will not exceed the greater of the amount you paid to Bigger Referrals during the 12 months before the event giving rise to the claim or $100. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Bigger Referrals and its operators from claims, damages, losses, liabilities, and reasonable costs arising from your submitted content, your referral activity, your dealings with another member or prospective client, your violation of these Terms, or your violation of another person's rights.

18. Suspension and termination

You may stop using the Service at any time. We may restrict, suspend, or terminate access for security concerns, nonpayment of membership fees, violations of these Terms, unlawful conduct, misuse of data, material risk to the Service or its users, or other legitimate operational reasons. Where practical, moderation and suspension decisions are reviewed by a person rather than imposed solely by an automated score.

Provisions that by their nature should survive termination, including ownership, disclaimers, limitations of liability, record integrity, dispute provisions, and payment obligations between members, will survive.

19. Governing law and venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Except where applicable law requires otherwise, claims relating to these Terms or the Service must be brought in the state or federal courts with jurisdiction in Pierce County, Washington.

20. Changes to these Terms

We may update these Terms as the Service, law, or business changes. We will update the effective date and, when appropriate, provide additional notice of material changes. Continued use after an updated version takes effect constitutes acceptance of the revised Terms to the extent permitted by law.
